GSTR-5A filing for OIDAR providers: the monthly GST return filed by non-resident online information and database access or retrieval service providers for supplies made to unregistered persons in India, due by the 20th of the following month

GSTR-5A is the GST return filed by non-resident providers of Online Information and Database Access or Retrieval (OIDAR) services for supplies made to unregistered persons in India. It reports the taxable supplies and tax payable for the period and is filed monthly, by the 20th of the following month.

GSTR-5A is a monthly return that non-resident Online Information and Database Access or Retrieval (OIDAR) service providers must file on the GST portal. This guide covers eligibility, step-by-step filing, liability offset procedures, and final submission using DSC or EVC.

What Is GSTR-5A?

GSTR-5A is a Goods and Services Tax return specifically designed for non-resident OIDAR service providers. OIDAR refers to services delivered over the internet or an electronic network with minimal human intervention. Common examples include cloud computing platforms, digital advertising services, online databases, streaming services, software-as-a-service products, and electronic content distribution.

These providers operate from outside India and supply services to non-taxable or unregistered recipients within the country. Since the recipient is unregistered and cannot pay GST under the reverse charge mechanism, the obligation to pay the tax falls on the OIDAR provider. The return captures taxable outward supplies, amendments to prior period data, tax liabilities, and interest details for each tax period.

OIDAR providers must register under a simplified GST registration scheme specifically created for non-resident digital service providers. This simplified registration does not require a physical presence in India, and the provider is assigned a unique GSTIN for compliance purposes.

Who Must File GSTR-5A?

Only non-resident OIDAR service providers registered under the simplified GST registration scheme must file GSTR-5A. The filing obligation applies to entities providing online information or database access services from outside India, providers supplying retrieval services to unregistered or non-taxable persons in India, any foreign digital service provider covered under Section 14 of the IGST Act, and intermediaries or agents appointed by OIDAR providers who are responsible for paying tax on behalf of the principal.

If the recipient of the OIDAR service is a registered person in India, the reverse charge mechanism applies, and the recipient pays the tax. In that scenario, the OIDAR provider does not include those supplies in GSTR-5A.

How to File GSTR-5A on the GST Portal

Follow these seven detailed steps to complete your GSTR-5A filing on the official GST portal.

Step 1: Log In to the GST Portal

Navigate to the official GST portal at http://www.gst.gov.in and log in using your credentials. Ensure you use the simplified registration login assigned to your OIDAR entity. Verify that your registration status is active before proceeding with the filing.

Step 2: Navigate to the GSTR-5A Page

After logging in, follow this path to reach the filing page. Click on Services, then Returns, then Returns Dashboard. Select the relevant Financial Year and Return Filing Period (month). Click SEARCH to load the filing options. On the resulting page, click the PREPARE ONLINE button on the GSTR-5A tile.

Step 3: Enter Supply Details in the Relevant Tiles

The GSTR-5A form contains several tiles for entering information on different categories of supplies. Each tile must be completed accurately before submission.

Tile 5: Taxable Outward Supplies to Indian Consumers. This tile captures details of taxable supplies made to consumers in India during the tax period. Click on Tile 5, then click ADD DETAILS to add a new Place of Supply. Select the Place of Supply from the dropdown, enter the taxable value, applicable rate, and tax amount. Click ADD to save the entry. Repeat for additional state-wise supplies at different rates. After entering all supply details, click SAVE. The system will display the Total Taxable Value and Total Tax Liability. Ensure each Place of Supply is correctly identified, as IGST is charged based on the recipient’s location in India.

Tile 5A: Amendments to Taxable Outward Supplies. Use this tile to amend details reported in earlier periods. Click Tile 5A, then select the Place of Supply and the original filing month and year. To add missed entries, click ADD DETAILS and enter revised values. To modify existing entries, click Edit. To remove a record, click Delete. After making changes, click SAVE. The Place of Supply cannot be revised during amendments. Only supply values can be corrected.

Tile 6: Interest or Other Amounts. Click Tile 6, then select Place of Supply from the dropdown. Enter the interest amounts under the integrated tax and cess columns. This tile is used when interest payments are due on delayed tax remittances from prior periods. Click Save to record the entries.

Step 4: Preview the Draft GSTR-5A

Click the PREVIEW DRAFT button to review a PDF version of your GSTR-5A. This step is critical for catching errors before the filing becomes irreversible. Verify all entries across Tiles 5, 5A, and 6. Cross-check the Place of Supply allocations, taxable values, and tax amounts against your internal records.

Step 5: Initiate the Filing Process

Click the INITIATE FILING button to begin the formal filing process. This action freezes all information entered for the month. After initiating, click CONFIRM AND SUBMIT to finalise the data. The status changes to “Submitted,” and no further edits are possible.

Before initiating, ensure your Electronic Cash Ledger has a sufficient balance to cover your tax liability. If the balance is insufficient, generate a challan on the GST portal, complete the payment, and confirm it reflects in your ledger. After confirmation, Tile 6, Tile 7, and the PAID AT CBIC PORTAL button become active.

Step 6: Offset Liabilities

You can offset liabilities through one of two paths, depending on your payment status.

If liability is not yet paid via the CBIC Portal, click on Tile 7 to view payable interest or other amounts. Click CHECK LEDGER BALANCE to verify your Electronic Cash Ledger balance. Enter the amount to be paid under the relevant tax heads. Click OFFSET LIABILITY to complete the offset. A debit entry number is displayed upon successful offset.

If liability has already been paid via the CBIC Portal, click PAID AT CBIC PORTAL and select Yes. Enter the Payment Reference Number (alphanumeric, up to 25 digits) and the payment date. A credit entry is posted to the Electronic Liability Register, enabling you to file the return. CBIC authorities may subsequently verify the payment.

Step 7: File GSTR-5A with DSC or EVC

Tick the box next to the Declaration, select the appropriate Authorized Signatory from the dropdown, and click either FILE GSTR-5A WITH DSC or FILE GSTR-5A WITH EVC.
